II. The probation period will be 15 days (from working days).If Party B is capable of doing all tasks and have good health, the period of service will be from to
. Otherwise, Party A doesn’t engage the service of Party B, Party A only provide 50% of wage of working days during the probation period, and 50% of one- way train ride expenses from school to the city which Party B enters into China.
III. Party A’s Obligations
Party A shall introduce Party B the law, decrees, relevant regulations enacted by the Chinese government and the working system of Party A, especially the regulations concerning administration of foreign experts.
Party A shall conduct supervision and evaluation of Party B’s work.
Party A shall provide meals and housing for free.
Party A shall provide co-workers.
Party A entrusts the appointed bank with paying the ultimo salary by the 3rd of each month.(The date will be delayed if meeting the holidays.)
Party A shall respect Party B’s religious belief and customs.
Party A shall provide Party B with necessary working and living conditions.
IV. Party B’s obligations
Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China’s internal affairs.
Party B shall comply with Party A’s work system and regulations concerning administration of foreign experts and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.
Party B shall complete the tasks agreed on schedule and guarantee the quality of work.
Party B shall respect China’s religious policy, and shall not conduct activities incompatible with statue of an expert.
Party B shall respect the Chinese people’s moral standards and customs.
Party B’s total working time will be 40 working hours per week(5 days per week), e.g.: 25 lessons at least each week (40--45minutes per period ).
Party B will attend activities held by Party A regularly.
Party B should try to set up excellent atmosphere for Party A students
V. The salary treatment
Monthly salary RMB per month. The salary will be paid monthly with RMB from the day of starting the work to the expiration of the contract, except summer and winter holidays. Party B will be given summer or winter allowance if he or she works the whole year(two semesters). In case of the time shorter than a whole month, the payment shall be counted by day. The daily wage shall be 1/30 of the monthly salary. If Party A asks Party B to have extra classes on holidays, including summer and winter vacations and other non-working days, Party B will be paid.(If the period is 45minutes, Party B will be paid 50 RMB/period. If the period is 40minutes, Party B will be paid 42 RMB/period.)
Party B’s salary will be related to work attendance. Being late, absence and missing for classes or not to be satisfied by either the students or the teaching department will be given discounted salary.
If Party B works the whole school year (two semesters), Party B will be given allowance once(summer- holiday allowance or winter-holiday allowance). At the end of first semester, Party B will be given 1100RMB for holiday allowance and medical insurance that Party A provides.
If Party B works the whole year(two semesters), Party A will provide international return air ticket once a year. (International economy class air ticket for the nearest distance between China and the country of the employed party. The one-way air ticket should be less than 3000RMB, if it’s more than that, the extra part should be paid by Party B himself/herself.). At the end of the first semester, Party B will be paid one-way air ticket, and the other one-way air ticket will be paid at the end of the second semester. Party B should provide the used air tickets which should be within the contract term.
5. Party B is entitled to and will be paid for festivals in China, such as National day and other festivals stipulated by laws and regulations.
6. The employed party is entitled to and will be paid for the following festivals corresponding to their nationalities and religious: one day for Christmas.
7. Party A will pay electricity(not more than 300 RMB). The extra part should be paid by Party B himself/herself.
VI. Sick leave and private affairs leave
Certificate from the hospital for foreigners appointed by the host school should be presented when the employed party asks for sick leave. During one month, if the sick leave’s amount is one day, no salary will be cut, for two days sick leave,30 percent of two day salary will be cut, for three days,50 percent of the three day salary will be cut, for four or more than four, 100 percent of sick days salary will be cut.
During the term of the contract, Party B should pay the medical care expenses if in hospital while traveling or going out of school.
Private affairs leaves of the employed party shall be approved by the host school. The host school will deduct the salary by day. In the contract term (one year or one academic year), the private affairs leaves should not exceed 10 days. The continuous private affairs leaves shall be no more than 3 days, and two days’ salary will be deducted for each day thereafter. In case of absence from work without the host school’s permission, 3 days’ salary will be deducted for each day absent. For serious circumstances, the host school has right to terminate the contract and investigate the liability of the employed party for violation of the contract.

VII. The Credit Bail
The employed party that is engaged through self-recommendation or others’ introduction shall pay a certain amount of credit bail (600$ to 1,000 $, or the equivalent in RMB) before entering so as to prove his /her good faith for employment. The host school shall handle the formalities for the employed party to enter China after receiving the bail. The bail shall be returned to the employed party until the employment ends. If the employed party has difficulty to pay the credit bail, he/she can purchase the air ticket by oneself, and the air ticket can be regarded as the credit bail, the air ticket can only be reimbursed before the expiration of the contract.
VIII. Modification, Termination, Cancellation of the Contract
1. Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent. The contract can be revised, canceled, or terminated with mutual consent, and it will be confirmed in written form. Any agreement in unwritten form should be ineffective. Before both parties have reached an new agreement, the original contract should be strictly observed.
2. Party A has the right to cancel the contract with a written notice to Party B under one of the following conditions:
①Party B does not fulfill the contract or does not fulfill the obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.
②According to the doctor’s diagnosis, Party B can not resume normal work after a continuous 15--20 days sick leave within one month.
Party B has the right to cancel the contract with a written notice to Party A under one of the following conditions:
①Party A has not paid Party B on schedule.
②Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
4. After canceling the contract, Party A will pay Party B daily wages according to the working days.
IX. Breach penalty
When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated ,that is ,break the agreement, it must pay a breach penalty of US500——5,000$ (or the equivalent in RMB)
If Party B asks to cancel the contract due to events beyond control, it should provide certifications by the department concerned, and obtain Party A’s consent. Then the contract can be canceled, and Party B should pay its own return expenses ; If Party B cancels the contract without valid reasons, it should pay its own return expenses and pay a breach penalty (500$—5000$ or equivalent to RMB ) to Party A .
If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, the contract can be canceled, and it should pay Party B’s return expenses. If Party A cancels the contract without valid reasons , it should pay Party B return expenses and pay a breach penalty (500$ to 5000$ or equivalent to RMB) to Party B
X. This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks to sign a new contract, it should put forward its request to the other party 90 days prior to the termination of the contract, and sign the new agreement with mutual consent. The employed party will bear all expenses incurred and be responsible for himself/herself when staying on after the contract expires,.
XI. Arbitration
The two parties shall consult with each other and mediate any disputes which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts’ affairs in the State Administration of Foreign Experts Affairs and ask for a final arbitration.

XII.SIGNATURE
This contract is signed at Weihai Daguanghua International School Province of People’s Republic of China, in duplicate. The contract is in both Chinese and English , both texts being equally authentic. If there is a contradiction between the Chinese text and the English one, the Chinese one will be based on.

一、甲方因学校工作需要特聘请 籍 为英文教师。双方本着友好协商的原则,自愿签订本合同,并保证认真履行合同中约定的各项责任和义务。
二、乙方试用期为15天(按实际从事教学工作日起计算)。如乙方试用合格,则合同期自 年 月 日起至 年 月 日止。如乙方因健康或专业能力考核不合格,则甲方不聘用乙方,但甲方承担乙方试用期间的课时工资的50%和入境城市至学校所在城市单程火车硬卧交通费的50%。
三、甲方的责任与义务
1、向乙方介绍中国有关法律法规、生活习俗和甲方相关工作制度特别是有关外国教师的管理规定。
2、对乙方的工作进行指导、检查和评估。
3、向乙方免费提供食宿。
4、为乙方配备合作共事人员。
5、委托指定银行于每月3日前(如遇节假日顺延)代发乙方上月薪金。
6、尊重乙方的宗教信仰和民族习俗。
7、向乙方提供必要的工作和生活条件。
四、乙方的责任与义务
1、遵守中国的法律、法规,不干预中国的内部事务。
2、遵守甲方的工作制度和有关外国专家的管理规定,接受甲方的工作安排、业务指导、检查和评估。未经甲方同意不得兼任与甲方无关的其他劳务,尤其是不能从事与甲方有竞争关系的任何事务。
3、按期完成甲方指定的工作任务,保证工作质量。
4、遵守中国的宗教政策,不从事与教师身份不符的活动。
5、尊重中国人民的道德规范和风俗习惯。
6、每周工作时间为40小时,每周5个工作日,每周不少于25课时(每节课时为40—45分钟)。
7、不定期出席甲方举办的各种活动。
8、为甲方学生营造良好的英语学习氛围。
五、工资及其它待遇
1、乙方每月薪金为 元人民币,合同期内,薪金按月支付。工资自工作之日起至合同终止之日止,寒暑假除外,享受假期津贴。若工作不足1月者,每日工资为月薪的1/30。若甲方要求乙方在工作日之外时间加班,则向乙方支付加班工资(一节课为45分钟,报酬为50元人民币;一节课为40分钟,报酬为42元人民币)。
2、乙方的月工资与甲方制订的考勤与教学考核挂钩。乙方若有迟到、旷课、教学考核不合格等,甲方有权按规定扣减乙方相应的工资。
3、如果乙方在甲方工作满一学年,享受一次假期津贴。第一学期结束时甲方发给乙方假期(寒或暑假)津贴1100元人民币,乙方在甲方工作期间,享受甲方提供的医疗保险。
4、如果乙方在甲方工作满一学年,甲方向乙方支付一次国际往返飞机票费用(指中国与乙方所在国家城市最短距离的经济舱飞机票。单程机票最高额不超过5000元人民币,超额部分由乙方自理),但乙方必须提供合同期内的机票凭证。第一学期结束时,甲方报销乙方单程机票,余下部分第二学期结束时一次性付清。
5、乙方有权享有中国节假日,如国庆节及国家规定的其他节假日。
6、乙方有权享有其本国的节假日,如圣诞节可休假1天。
7.学校支付电费不超过300元,额外部分由乙方自己承担。
六、病假和事假
1、乙方请病假需出示医院证明,此医院必须是甲方为外籍教师指定的专门医院。一个月内,1天病假不扣除当天课时工资;2天病假扣除相应时间课时工资的30%;3天病假则扣除相应时间课时工资的50%;4天及4天以上病假则不发放相应病假时间的课时工资。
2、在合同期内,乙方在外出、假期旅行期间生病时医疗费用由乙方独自承担。
3、乙方请事假须经甲方同意。甲方将按事假天数,扣除相应的工资。在合同期内,事假累计不得超过10天,一次连续请事假不得超过3天。否则,每请1天事假将扣除2天的工资。如未经甲方允许,擅自旷工,每旷工1天扣除3天的工资。情节严重的,甲方有权终止合同并追究乙方违约责任。
七、信用委托金
经自荐或别人推荐被录用的乙方,在来甲方工作之前,要交纳600—1000美元(或等额人民币)的信用委托金,以证明乙方对此次雇用的信誉。收到信用委托金后,甲方将向乙方出示相关凭证,并为乙方办理来华工作的各项事宜。当合同终止时,信用委托金由甲方全额退还给乙方。如乙方缴费有困难,经甲方同意,可将自己所购买的来华飞机票作为“信用委托金”的代金券,作为代金券的飞机票只能在合同期满后由甲方按规定报销。
八、合同的变更、解除和终止
1、双方应信守合同,未经双方协商同意,任何一方不得擅自更改、解除或终止合同。合同中每一条款的规定的修改,必须在双方协商后,以书面的形式来确定,任何口头的协议都将视为无效。合同若有变更,在未达成一致意见前,仍应严格按原合同执行。
2、乙方有下列情况之一者,甲方有权以书面形式通知乙方解除合同:
①乙方不履行合同或者履行合同不符合约定的条件,经甲方指出后,仍不改正者。
②一个月内,乙方病假累计超过20天(含20天)或连续15天(含15天)不能正常工作者。
3、甲方有下列情况之一者,乙方有权以书面形式通知甲方解除合同:
①甲方未按时支付乙方报酬。
②甲方没有为乙方提供必要的工作和生活条件。
4、合同终止后,甲方按乙方实际工作日结算课时工资。
九、违约金
1、当事人一方不履行合同或者履行合同不符合约定条件,即违反合同时,须向守约方支付违约金500—5000美元(或等额人民币)。
2、乙方因不可抗拒的事件要求解除合同,需出具市级或市级以上涉外机构证明,经甲方同意后,可以解除合同,乙方离华费用自理;乙方若无故解除合同,除离华费用自理外,还须向甲方支付违约金500—5000美元(或等额人民币)。
3、甲方因不可抗拒的事件要求解除合同,经乙方同意后,可以终止合同,乙方离华费用由甲方负担;甲方若无故解除合同,除负担乙方离华费用外,还应当向乙方支付违约金500—5000美元(或等额人民币)。
十、本合同自双方签字之日起生效,合同期满自行失效。当事人一方要求签订新合同,必须在本合同期满90天前向另一方提出,经双方协商同意后签订新一轮合同。乙方合同期满后,在华逗留期间的一切费用自理,一切责任自负。
十一、仲裁
当事人双方发生劳务合同纠纷时,尽可能通过协商或者调解解决。如协商、调解无效,可向中华人民共和国外国专家局设立的外国文教专家事务仲裁机构申请仲裁。
十二、本合同于 年 月 日中华人民共和国威海大光华国际学校签订。本合同一式两份,每份均用中文和英文写成,两种文本具有同等法律效力。如两种文本发生歧义,以中文文本为准。
